5-Year Sunset Clause for Federal Tax Benefits in the Fiscal Responsibility Law: Ending Perpetual Unaudited Subsidies

Sectoral tax breaks and credit subsidies are usually created in Parliament with a temporary justification: stimulating a sector facing a cyclical crisis, attracting productive investment to a region, or supporting a technological transition.

In Brazilian budgetary practice, however, what begins as a temporary incentive almost always turns into a perpetual entitlement. Once granted without an expiration date, a tax benefit is rarely re-evaluated, and repealing it requires a difficult political vote against organized interest groups. Meanwhile, the bill falls silently on all other taxpayers and workers, who pay higher general tax rates to make up for foregone revenue.

This study presents the constitutional basis, the summary ready for popular support on the Federal Senate e-Cidadania Portal, and the complete technical draft of a Complementary Bill (PLP) that adds Art. 14-B to the Fiscal Responsibility Law (LC No. 101/2000), establishing a 5-year maximum validity period (sunset clause) for federal tax, financial, and credit benefits to companies, sectors, or regions, and conditioning any renewal on a public outcome evaluation published 12 months before expiration.

1. Reversing the Burden of Proof: Those Who Want to Keep a Subsidy Must Prove It Works

By adding Art. 14-B to the Fiscal Responsibility Law (LC No. 101/2000), grounded in Art. 163, item I (general public finance rules) and Art. 165, paragraph 6, of the Federal Constitution (regionalized statement of the revenue and expenditure impact of exemptions, amnesties, subsidies, and benefits), the proposal establishes a permanent governance rule:

  1. Maximum Validity of 5 Years (Art. 14-B, caput): Every grant, expansion, or extension of a federal tax, financial, or credit benefit aimed at legal entities, economic sectors, activities, or regions shall have a maximum validity of five years.
  2. Targets and Indicators from Day One (Art. 14-B, paragraph 1): The law granting or expanding the benefit must specify its objectives, quantifiable targets, outcome indicators, and the agency responsible for evaluating it.
  3. Public Evaluation 12 Months Before Expiration (Art. 14-B, paragraph 2): Renewal may only occur through a new law, accompanied by an outcome evaluation published up to 12 months before expiration showing:
    • Actual fiscal cost in each fiscal year;
    • Fulfillment of the targets and indicators set in the enabling law;
    • Estimated effects on formal employment, investment, and tax collection; and
    • Comparison with alternative public policy instruments for the same objectives.
  4. Advisory Opinions from the IFI and TCU (Art. 14-B, paragraph 3): The Independent Fiscal Institution (IFI) and the Federal Court of Accounts (TCU) may issue technical opinions on the evaluation to inform the debate, while keeping final decision-making authority with the National Congress.

2. Legal Certainty and Constitutional Safeguards (Art. 14-B, § 4 and Art. 2)

Legal SafeguardDraft ProvisionWhy It Matters

3. Text Ready for Popular Support (Senate e-Cidadania Portal)

To register or support this legislative idea on the Federal Senate e-Cidadania Portal, copy the summary below:

TITLE: Five-year expiration period for tax benefits granted to sectors and companies

PROBLEM: Tax benefits and subsidies for specific sectors are created as temporary measures, but end up lasting forever without any evaluation of results. The cost falls on all taxpayers, who pay higher taxes to make up for the foregone revenue.

PROPOSED SOLUTION: Amend the Fiscal Responsibility Law so that:

  1. Every federal tax, financial, or credit benefit for companies, sectors, or regions has a maximum validity of five years, with targets defined from its creation.
  2. Renewal only occurs through a new law accompanied by a public evaluation published one year before expiration, showing cost, target fulfillment, and effects on jobs, investment, and tax collection.
  3. Existing open-ended benefits have five years to be evaluated and renewed, or else expire. Simples Nacional, the Manaus Free Trade Zone, constitutional immunities, and benefits mandated by the Constitution are excluded.
